1. Introduction

1.1. This Privacy Policy describes how and when Panomio ApS (“Panomio” or “we”) collects, uses, and protects your personal data when you use panomio.com (“Panomio” or “Platform”) via Home.

1.2. Panomio ApS is a Danish SaaS company that provides an online platform called Panomio which enables registered trial users and subscribers (“User/Subscriber” or “you”) to create, distribute, and use e-courses. Panomio is located at Amager Strandvej 392 DK-2770 Kastrup Denmark and is incorporated and existing under the laws of the Kingdom of Denmark.

1.3. We deal with your personal data in strict compliance with the European General Data Protection Regulation (GDPR) and other applicable data protection laws and regulations.

2. Collection

2.1. When you sign up for Panomio, you provide us with personal data such as name, email, phone number, and organisation name. As the registered user, you are the administrator of your Panomio account. As administrator, you can enrol users who will have access to the courses you created. To enrol users, you have to provide their email addresses. Please ensure that you have the user’s consent to be enrolled in the system. This is your responsibility as the administrator. Please refer to the Data Processing Agreement under the General Terms and Conditions for your obligations as data controller.

2.2. When you subscribe to the paid subscription, we may collect additional information such as but not limited to your billing address, other contact information, and purchase history.

2.3. We also collect information in several ways through the Platform such as frequency of usage, duration of your sessions, and the contents you view within the Platform. We will also be able to access contents such as the texts, images, PDF documents, audio and video files you create and upload to the Platform. Panomio does not claim ownership over project content made by its users/subscribers. To know more about proprietary rights, please see our General Terms and Conditions.

2.4. We use cookies to enable the Platform to work. You have the option to either accept or refuse cookies and know when a cookie is being sent to your computer. If you choose to refuse our cookies, you may not be able to use some portions of our service. For further information on our use of cookies, please see our Cookie Policy.

3. Processing and Use

3.1. We process your personal data for us to manage our relationship with you by way of managing your account and providing you with access to use the Platform. All communication  related to Panomio service is done via email unless an additional means is later agreed such as us via phone call or video call. This data processing is done to fulfil our contractual obligation as a SaaS provider.

3.2. We also process your personal data to provide support and improve our services. As such, we may use your contact information to provide you information such as how to use the Platform, how to improve your user experience, and send you Platform-related updates such as new features. This data processing is done to improve your user experience, and provide our support services.

3.4. Based on your freely given consent, we may use your personal data to send you Panomio news, offers, and events. Your consent is asked when you sign up for a free trial, subscribe to it on our website, or at a later stage. You may withdraw your consent at any time by clicking the “Unsubscribe” button in the email, or by contacting us directly to request to be removed from our mailing list.

4. Third-party Sharing

4.1. It is our general policy to not disclose any personal data to third-parties. However, we may share your data when we employ a third-party to perform any of the following services on our behalf: to facilitate our Service; to provide the Service on our behalf; to perform Service-related services; or to assist us in analyzing how our Service is used.

We protect your personal data by obligating such third-party to not disclose or use your personal data for any purpose other than what we have employed them for.

4.2. We may share personal data regarding you if we are obligated to do so by law, to enforce our terms of service, to protect us against loss or damage. This may include exchanging information with the police, courts or law enforcement organisations.

4.3. If we sell our business or our company assets are acquired by a third-party, personal data held by us about our users may be one of the transferred assets.

5. Retention and Deletion

5.1. We store your personal data for as long as your account is active, and for a year from the time your account activity stops in free subscription or two years after your paid subscription is cancelled. We may also store some of your personal data beyond the stated period to comply with our legal obligations.

5.2. Your account may be  deactivated due to reasons such as delay in payment, or long period of inactivity. In such a case, your data is retained, and it is only your access to your account that is suspended.

5.3. You may add, update, correct or request us to correct data regarding your Panomio account, but be aware that we will maintain a copy of unrevised information in systems back-ups for a certain period until our back-up is updated with the latest version.

5.4. In case you delete your account, we will delete your data linked to such account including your username. The username will not appear on reviews or comments, if any, and will be anonymous for future viewing. Some data may be retained and will be completely deleted only when our back-up is updated with the latest version.

6. Security

6.1. User accounts including personal data are protected by a password for your privacy and security. Users should protect their account and personal data from unauthorised access and use by choosing and protecting passwords appropriately, and by signing off properly after use.

6.2. We do our best to ensure that user accounts are kept private. However, instances such as unauthorised entry, hardware or software failure, and other factors may compromise the security of your personal data. If a breach of security which can result in a risk of data theft is discovered by us, we will contact you via email within 72 hours.

7. Children's Privacy

7.1. Panomio may only be used and purchased by users 18 years old and above.  Panomio does not knowingly collect personal data from children under 18. In the case we discover that a child has provided us with personal data, we will immediately delete such data from our server. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us so we can take the necessary action.

8. Changes

8.1. This Privacy Policy may be revised from time to time, thus, we advise you to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.

8.2. We will use your personal data in accordance with this Privacy Policy. In case we need to use your data for any other purpose not mentioned here, we will ask for your consent to process your data for a specific new purpose.
